The EnjoyCN team (the Company, we, our, us) and its licensees operate under the following software end - user license agreement. By downloading and/or using any of the EnjoyCN team's programs, you acknowledge that you have agreed to the terms of this agreement.
For the purposes of this agreement, "you" refers to the end - user, and "the EnjoyCN team" refers to the EnjoyCN team, its employees, and any independent developers who have licensed their software to the EnjoyCN team.
You are granted a non - exclusive right to use any of the EnjoyCN team's programs that you have purchased. You may use the programs distributed as "shareware" on a trial basis. Paying a registration fee entitles you to continue using the program for which the registration fee was paid.
The software is licensed, not sold. All software, help files, etc. are and will remain the property of the EnjoyCN team.
All programs are provided "as is" without any warranty of any kind, whether implied or expressed, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. The entire risk regarding the quality and performance of the program lies with the user. If the program proves to be defective, you, not the EnjoyCN team, assume the entire cost of any necessary repairs or corrections. Since some states do not allow the exclusion of implied warranties, the above exclusion may not apply to you.
The EnjoyCN team does not warrant that the functions contained within any of its programs will meet your requirements or that the operation of any of its programs will be uninterrupted or error - free.
Under no circumstances will the EnjoyCN team be liable to you for any damages, including but not limited to lost profits, business interruptions, or other incidental or consequential damages arising from the use or inability to use the programs (whether or not due to any defects therein), even if the EnjoyCN team has been informed of the possibility of such damages, or for any claim by any other party. Because some states do not allow the limitation or exclusion of liability for consequential damages, the above limitation may not apply to you.
You are responsible for the accuracy of the information you provide to EnjoyCN and, upon request from EnjoyCN, shall verify the accuracy of the information given.
You may not create an EnjoyCN account for others or allow others to use your EnjoyCN account. If you discover unauthorized use of your account by others, you shall immediately notify EnjoyCN.
In consideration of our services, you agree that EnjoyCN has the right to place advertisements or other types of commercial information. You also agree to receive advertisements or other relevant commercial information from EnjoyCN via email or other means. When using EnjoyCN services, you must abide by all applicable laws, regulations, and all rules and policies of EnjoyCN.
You may only share information that you are comfortable sharing with the public. You may not distribute via EnjoyCN any content that may be considered:
You may not impersonate any other individual, entity, government agency, or organization.
You may not publish or distribute other people's private information without their express authorization and permission.
You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish or distribute any copyrighted or proprietary works. You are solely responsible for obtaining such licenses, rights, consents, and permissions. You may not publish or link to any malicious code, phishing websites, or other content that may threaten the security of the Internet.
EnjoyCN has the right to review and monitor your behavior on EnjoyCN. If EnjoyCN, at its sole discretion, reasonably believes that you have violated the terms of use, EnjoyCN may freeze, suspend, disable, ban, or revoke your account.
If your account is frozen, suspended, disabled, banned, or revoked, you may not create a second account or ask anyone else to create a second account for you.
If you violate any terms of use, you shall indemnify and hold EnjoyCN harmless from any liability resulting from a claim by a third party in relation to your violation.
We reserve the right to change the content of our services from time to time at our discretion, with or without notice.
Some of the services provided by EnjoyCN require payment. For paid services, EnjoyCN will give you explicit notice in advance, and you may only access such services if you agree to and pay the relevant charges. If you choose to decline to pay the relevant charges, EnjoyCN is not obliged to provide such paid services to you.
EnjoyCN needs to perform scheduled or unscheduled repairs and maintenance. If such situations cause an interruption of paid services for a reasonable duration, EnjoyCN shall not bear any liability to you and/or any third parties. However, EnjoyCN shall notify you as soon as possible.
If any of the following events occur, EnjoyCN has the right to suspend, terminate, or restrict the provision of services under this agreement at any time and is not obligated to bear any liability to you or any third party:
Except for the express representations and warranties set forth in this agreement, EnjoyCN makes no warranty in connection with the subject matter of this agreement, and EnjoyCN hereby disclaims any and all other warranties, whether statutory, express, or implied, including all implied warranties of title, non - infringement, merchantability, fitness for a particular purpose, and any implied warranties arising from course of dealing or performance regarding such subject matter.
This platform and its associated services are provided strictly in accordance with the laws of the jurisdictions in which such access and participation are lawful.
The platform and/or the company expressly disclaims all liability and responsibility for any violation of local laws committed by users accessing the platform from prohibited jurisdictions. Each user is solely responsible for determining whether access to and participation in the platform's offerings are permitted under the laws applicable to them.
As a merchant, we shall not be liable for any loss or damage arising directly or indirectly from the decline of authorization for any transaction due to the cardholder exceeding the preset limit mutually agreed upon by us and our acquiring bank from time to time.
Currently, EnjoyCN does not offer an official refunds and cancellation policy.
Your use of any software produced by EnjoyCN implies that you acknowledge that you have read this agreement, understand it, and agree to be bound by its terms and conditions. You further agree that it is the complete and exclusive statement of the agreement between you and the EnjoyCN team, superseding all previous proposals or agreements, whether oral or written, and all other communications between you and EnjoyCN regarding the subject matter of this agreement.
This agreement may only be modified by a written agreement signed by both you and EnjoyCN. If any portion of this agreement is held invalid, the remainder of the agreement shall still be considered enforceable.
These terms and conditions are governed by the laws of the territory in which the EnjoyCN team is registered.
